Masters Class Gives Last Place Open Competitors Something to Brag About

$

Masters divisions have their critics considering there typically is no prize money and no Masters Olympia. However, as with the 2018 IFBB Pro league San Antonio Pro the Men's Physique Masters Division provided five of the 16th open placing competitors bragging rights with a number above the dreaded last place tie. Doug Laforge stated on Instagram, "7 th place finish will have to do 😳 this round but we be back with a vengeance in 2019," but he omitted any reference to his 16th place in open.
Interestingly also the judging panel placed the Masters competitors in a sequence consistent with their open placings without having any do better than in open, which raises the obvious question of whether the masters competitors were judged again whatsoever or merely placed based on open scores?
Regardless, the masters division gives us better insight into where the last place competitors in the open would rank if an actual number was assigned them besides the 16th place “48” point tied designation. Thank you so much IFBB Pro League for supporting the athletes dreams and aspirations. #REV16.

Twenty-five Bikini Pro Casualties at Alamo Saturday, October 6, 2018

The Alamo 2.0 took place on Saturday night, October 6, 2018. Under the bright lights in San Antonio large numbers of wounded bikini wearing casualties piled up while the officers of the IFBB Pro League were doubtlessly claiming victory considering the tremendous troupe of g-string wearing beauties that showed up for booty & bust battle royale. Yet, the wounds will be lasting ones with some likely to never recover or lose interest considering there were more casualties to the 25 way tie for last place in the open class than placed with five receiving the additional dagger of 16th place in masters.
As with the men’s pro physique division the masters competitors in bikini placed in matching order to their open placings with no not one jumping ahead of someone else who bruised them in open battle. When this occurs athletes, fans and the press wonder if it was a matter of not rejudging where the athletes physiques and presentation if changed significantly enough might warrant a change in order of placing or possibly or not. In the case of San Antonio Pro the odds are the masters classes were not rejudged independently although for bikini there was a peppering of additional athletes in the mix. As three of the four athletes that competed exclusively in the masters bikini division placed above five who likewise placed 16th in open should the take away be that it was better to only compete in masters as a sacrament against 16th? While the regularly repeated ethos about a “16th” placing is that if one does so poorly such placing doesn’t deserve further delineation to demonstrate actual comparative placings when there are more athletes tying for last place in one show than place 15th or above it suggests a tipping point where athletes as customers won’t merely blame themselves for not being good enough, but question whether fighting for the Alamo in a $2000 bikini is worth it. Every soldier deserves recognition for their number of kills as well as recognition of set backs. To merely say a soldier died in battle and was laid to rest in an unmarked grave akin to 16th place is hardly a flag worth fighting for especially where it costs $250 per year in membership and you can't get an actual legit placing to at least say you beat those other bikini wearing biotches that placed behind you battle. The number of sexy soldiers is lining up for the next battle, but the officers need to figure out how to keep cojoling them into this costly sacrifice as the ranks are bloating and these soldiers know their worth and its better than 16th place.
Remember the Alamo!

22 Figure Pros Tie for Last Place at 2018 Kentucky Muscle

Twenty-two IFBB Pro Figure Competitors tie for last place at IFBB Pro League Kentucky Muscle Victimized by the Good Old Boy Judging Criteria Set in Pittsburgh By Jim Manion. . The popularity and success of the Kentucky Muscle Pro is no accident as the promoter has done a terrific job over the years producing a great event with his own money along with his sponsors and the aid of volunteers and NPC & IFBB judging staff. Yet, last night 22 pro figure competitors did not place, but were given a 16th place designation, which is widely despised in amateur and pro ranks as indication that the competitor did not measure up, was actually shamefully ill prepared for stage competition and probably should not have been there. A simple solution to this group shaming in a subjective sport where there is often little difference among 1st, 11th & 22nd place is to actually provide a legitimate placing of 1st through last place. What other sports are there were 1st through a certain number are designated and the rest are denoted by last place? It's ridiculous traditional wisdom promulgated in women's divisions where one man Jim Manion makes every last decision foregoing any concern for appearance of impropriety running a 501c3 non-profit with out elections, quorum votes of committees, board of governor meeting minutes, etc. Whatever the elderly Manion and his son and now grandson choose to do is what the underlings including thousands of women must abide by. I support a Revolution of the 16th place competitors who deserve better both male and female in both the amateur and professional leagues. No participation awards and no coddling anyone, but publish the competitor's actual score! #REV16

Former ABBA President David Leung called Goodkey one of three “most qualified judges in the Province”. Goodkey joined the head judge team with Helen Bouchard and Robert Sano.
[Coincidentally, Bouchard pleaded guilty to illegally exporting and trafficking anabolic steroids in violation of Canada's Controlled Drugs and Substances Act (CDSA) back in May 2014.]"

NPC All South Sanction Goes to Carolina's based "KLASH" promoter

After a few decades of the NPC All South Championships being built up by Gene & Pete Fancher this year the Monsta Clothing owners of Tony & Chris we were told were being setup to take over the All South contest in 2018 and completely in 2019. I turned over website responsibilities to them myself in fact, which I'd done for over a decade. Then without fanfare it's announced by the Joe Pishkula, the recent Carolina transplant that he is incorporating the contest in his 2019 Carolina based "KLASH" series. While it was expected Pishkula would be taking over Florida shows in the reorganization of the state contests that includes a reduction in numbers to be announced at the Dec. 16, Ft Lauderdale sanctioning meeting it wasn't known that he would be taking over this particular show after the likewise discourteous manner in which he was appointed to Fancher's post similarly without fanfare or ceremony at the 2018 sanctioning meeting in Dec. 2017. Not a word of thanks came from Potter, Gardner or Pishkula for Fancher's nearly thirty years of dedicated service to his district athletes. Now this. The All South has had a great history that built it to the success it was in November of this year with probably its best turnout to date. Owning this contest sanction will provide Pishkula a great base to profit from in the NPC North District/Zone One as a reward from Pittsburgh to Pishkula as his cut in dividing up the Florida NPC. After posting about this last night Pishkula blocked me on social media, which is fine as I've still got access to see his Facebook promotions of his Carolina based contests that now include one of the great Florida NPC shows with more likely going to fall under the Carolina based "KLASH" banner. As with his original Border Klash in Aiken I was likewise the photographer at that first year show before he pushed that promoter aside and took that show as his own which he is now doing with the NPC All South. It will be interesting to see how deep the traditions and history of Florida's bodybuilding community will be altered under his leadership and that of the weak leadership of Mike in the North district and Gardner who will presumably run his portion of the state while physically at his shows around the country and abroad and amid his national and IFBB head judging responsibilities. Can one of the biggest states for NPC bodybuilding be reordered with recent transplants from "out of state", absentee personalities along with their bullying enforcers amid a smaller group of consolidated promoter numbers who know that their show could be the next one taken over by one of these district chairmen or eliminated to build attendance for one of their own? Time will tell.

Death Threats Lead to former NPC Athlete Arrest

NPC & UFE Bikini Competitor Tammy Steffen arrested after FBI investigation into her numerous death threats sent to other competitors. "The FBI became interested in Steffen long before her July arrest. Between August 2016 and July 2018, "Steffen engaged in a course of conduct with the intent to harass or intimidate six victims," according to Steffen's plea agreement released Friday."
Florida Bodybuilder Mom Sent Death Threats To Rivals
In a bizarre case, a 36-year-old Holiday mother and bodybuilder has pleaded guilty to sending death threats to competitors.
By D'Ann Lawrence White, Patch Staff | Dec 23, 2018
HOLIDAY, FL — In the latest twist in a bizarre case that has attracted national attention, a 36-year-old Holiday mother and bodybuilder has pleaded guilty to sending death threats to her competitors, including a former boss. U.S. Attorney Maria Chapa Lopez said Friday that Tammy Marie Steffen pleaded guilty to one count of cyberstalking and one count of sending threatening communications online. Steffen faces a maximum penalty of five years in federal prison for each count.
More Charges For Bodybuilding Mom
Shortly after Steffen's arrest, the Pasco County Sheriff announced that Steffen was facing additional charges of witness tampering for trying to convince her daughter to accept blame for filing a false kidnapping report.
Steffen called her daughter from the Land O' Lakes Detention Center on July 20 at 10:30 a.m. and instructed her to tell her father that the fake kidnapping plot was the daughter's idea, and that the daughter had supplied Steffen with money to buy the laptop case and notebook at Walmart.
In a second phone call, about an hour later, Steffen again encouraged her daughter to take responsibility for the kidnapping plot, saying, "You won't get in trouble, but I will." Steffen told her daughter that she would be charged with child neglect and wouldn't be able to see her.
When confronted about the phone calls, Steffen claimed she was simply giving her daughter permission to tell the truth and was not trying to manipulate the girl.
Case Grows More Bizarre
Beaman said the more detectives investigated the case, the stranger it became.
"There's more going on, probably, than we realize," he said.
His words proved prophetic.
Detectives found an earlier complaint from Steffen who called the Pasco Sheriff's Office to report a headless doll being placed on her front porch with a note that read: "New toy for the kids."
Detectives now say Steffen plotted with a friend on July 9 to place the headless doll on her own porch in an attempt to frame her ex-boss. When deputies failed to take her complaint seriously, she staged the attempted kidnapping.
The FBI became interested in Steffen long before her July arrest.
Between August 2016 and July 2018, "Steffen engaged in a course of conduct with the intent to harass or intimidate six victims," according to Steffen's plea agreement released Friday.
The FBI launched its investigation months before Steffen's arrest on the false attempted kidnapping charge. The complaint said she cyberstalked, harassed and threatened several of her former colleagues and associates through repeated emails, phone calls, text messages and social media messages from numerous phone numbers and accounts.
To date, the FBI has identified at least 369 Instagram accounts and 18 email accounts that Steffen created and used to send messages to her victims who "viewed the messages as true threats and suffered substantial emotional distress," the plea agreement said.
Victims are listed in court documents only by their initials: K.B., K.M. L.L., S.T., R.C. and M.X.
K.B., also a bodybuilding competitor, lives in Collier County. K.B. received 327 harassing Instagram messages and 129 emails from Steffen's known personal email accounts and 19 messages to K.B.'s business website.
To K.B: "Did you know you can put dog sh*t, egg property and so much more. Did you know it's not a crime at all LOL. Do not want you shocked at the laws as the next phase happens. Once put acid on a girls car with my ex-bestie melted that bitch to the group. right in a high school parking lot. You might know who it is but try to stop me. The wonderful thing is I know the laws. I can move around like always. You are not very smart. I sat in front of a judge with a smile on my face. He looked and said you are very bad. I just laughed. You picked the wrong path here. I feel for you but don't say I didn't warn you."
Another message to K.B. read:
"Time is up! You will reap Everything you have coming. I warned YOU. My full time job. Never try to contact me to settle this. That has passed. I am only sorry for all in your life. Let it spread like a wild fire. Bye b*tch. Even when you beg will I show no mercy."
Then there was this short, cryptic message to K.B. on July 8.
"You will die by my hands. You had you [sic]chance."
To H.J., she wrote:
"You could have helped your friends. You decided not to. You could have ended this a long time ago. You made all the wrong decisions. You will pay through watching those you care about pay. You will feel the pain you put me through. Checkmate you lost."
Victim K.M., who lives in Michigan, began receiving repeated, harassing and threatening messages from approximately 18 Instagram accounts and 21 emails from various accounts used by Steffen in November 2016.
"All hell is gonna rain fire down on your world like never seen before. You have picked the wrong person to mess with. You have no idea what you've done. I will be catching the next flight to Michigan out of here."
Agents say Steffen also tagged K.J. in a photo showing a woman holding two knives with the caption, "I'm coming."
R.C., the person who bore the brunt of Steffen's wrath, hired Steffen to work as a personal trainer in his Tampa gym in March 2016. He fired her in September 2016. He began receiving harassing messages from Steffen in January 2017.
On June 18, FBI agents executed a search warrant at Steffen's home, confiscating her cell phone and computer.
During interviews, Steffen admitted to creating a number of fake Instagram accounts to send disturbing messages to colleagues and fellow competitors.
She said she also made threatening phone calls from her son's cell phone to M.X.'s workplace.
Her computer browsing history showed she searched the websites iptracker.org; legalfakes.com; howtohackanigaccount.com;syphustraining.com; and mastersofrevenge.com.
She also searched the Mayo Clinic's website for an article titled "Narcissistic Personality Disorder."
What Happened To Tammy Steffen?
It's unclear what led Steffen to such peculiar behavior.
Steffan is listed as the co-founder of a company called Beyond Fit Bikini, although Patch could find no company under that name listed by the Florida Department of Business and Professional Regulation.
Steffen also competes in national health, fitness and bodybuilding competitions.
Judging by the Beyond Fit Bikini website that features before-and-after photos of her clients, Steffen appears to be a successful businesswoman.
Her biography says she has a bachelor of science degree in business management, is a registered dietitian and a certified personal trainer with the International Sports Sciences Association in sports nutrition, fitness nutrition and bodybuilding. She says she has "over 15 years of experience coaching athletes."
She also says she's a seasoned kick boxer, nail technician and lash specialist.
"As a competitor myself, I bring compassion and understanding of what it takes to make it to stage," she wrote on the website. "As a coach, I work one on one with each client to learn how their bodies best respond to nutrition, and which exercises maximize their growth. Ultimately, I bring my clients to the best physical shape of their life."
She describes herself as a "fit mom of two (although her Facebook page shows four children — two boys and two girls) active children, practicing an active lifestyle driven by the passion of setting a positive example for my two kids."
Her Facebook page under the name Tammy Masters makes no mention of feuds with colleagues or criminal charges against her.
Instead, she talks about coaching her kids' soccer team, her faith in God, setting up a GoFundMe page for her sister-in-law who is battling cancer and raising money with her children for the Wounded Warriors Project.
Her most recent Facebook message posted just after the U.S. Attorney announced the plea agreement with Steffen reads: "Darkness thought it had her, but it did not know her God. It did not know her story God was giving her to tell. 2019 let's go!"
In November, she wrote: "Just when they thought I was finished, I just smile thinking I have only began. This is my reason why." She included a photo of herself with her four children.
State records show Steffen married Jeffery Alan Steffen on Oct. 29, 2003 and they purchased the home on Mela Court the same year. They divorced this year on Aug. 23.
Steffen did not respond to requests for an interview.
Assistant U.S. Attorneys Rachel K. Jones and Lisa M. Thelwell prosecuted the federal case against Steffen. A sentencing hearing has not yet been set.
At a Dec. 18 arraignment before Pasco Court Judge Kimberly Campbell, Steffen, represented by defense attorney Jonathan Maguire, pleaded not guilty to the Pasco County charges of tampering with evidence, making a false report to law enforcement and obstructing justice.
Her next court date is March 12.

Florida NPC Loses One Of Their Finest Shows!

All Our Former Champions, Competitors, Supporters, Sponsors and Patrons of the Tampa Bay Classic,
It is with sincere and heartfelt regret that I John G. Schleicher, my family, and my loyal staff will no longer be able to produce and promote the NPC Tampa Bay Classic. This decision has not come easy, but after due consideration and evaluation, we have determined that the current direction and procedures that have been recently adopted by the new Florida State NPC team are not compatible with the goals and standards of the Tampa Bay Classic.
For 36 years now, we strive to produce the highest caliber, finest quality, and best presentation for bodybuilding, figure, bikini and physique athletes throughout the state. The Tampa Bay Classic served as the second oldest contest in the state of Florida. Mr. Peter Potter’s Southern States is the first and oldest NPC contest in Florida, and will continue to be as such. Since the very beginning and throughout all the years, the Tampa Bay Classic has always lived by the standard of putting the competitor first. We have always gone above and beyond to have the best organized and well-run show that we could provide. We have always showcased the competitor on beautiful and cutting edge stage sets and presented them all with fantastic custom made trophies, medallions and various awards. It has been our privilege and pleasure to meet and showcase these fine athletes throughout these many years.
Unfortunately, due to the new rules and regulations governed by the current Florida NPC leadership, especially within our own Central District, we have been directly informed that we can no longer run our own show and production as we see fit. For over 15 years, my sons, with support of key staff members have expedited and ran the entire production for both the pre-judging during the day, and the evening finals. This apparently is no longer allowed and the NPC Florida leadership has informed us that they will have to run the expediting entirely. My staff will no longer be allowed backstage or involved in the expediting of the production at any point during the show. When asked if we could finally become a national qualifier to better serve and attract more and more talented athletes, we were denied without hesitation. The reason given being that we lacked the ability and experience to handle this. We had been told that if we cleaned up our act and changed enough in favor of these new edicts, that maybe we could then have a chance to be a national qualifier in 2020. The sheer lack of respect and insolence towards me, my family, and my staff truly breaks my heart and leaves me discouraged and rather outraged. My family and I no longer wish to associate with the caliber of individuals who seek to shake your hand in sincerity whilst stabbing you in the back with their other hand.
We have always, since the very beginning in 1983 when Mr. Peter Potter asked me to envision and create a show in the Tampa Bay area, strived to follow all NPC rules and regulations. Over the years, we have adapted, refined, updated and improved whatever necessary to serve the best interest of the NPC and of course the athletes themselves. We have invested tens of thousands to update the stage set, create new and one of a kind trophies that stand above most, and we designed and developed a website that would allow athletes and patrons to register and purchase tickets with ease, convenience and security. Despite all we have done for the organization and athletes, our efforts do not satisfy and align with the standards and expectations of the new Florida NPC. Whether these ideals are supported by the NPC President or not remain unknown. However, attached to the body of this rather lengthy letter are pictures of the awards of service and gratitude, along with a personal signed letter from the President himself thanking me for all the years of service as “an outstanding promoter.” I and my family are truly at a loss.
On a more positive note, there are several individuals that I would like to personally thank and recognize as lifetime supporters and advocates of the Tampa Bay Classic. These esteems individuals are: Peter Potter, Pete Fancher, and Deke Warner. Peter Potter has been my friend since 1975 and judged me on the stage, advised and guided me as a promoter, and was one of the reasons I joined the NPC in 1982. Peter Potter was someone who shared my love for the sport and the love of the competitors, which gave us a common bond we continue to share to this day. I will never forget his friendship, support and guidance over the forty plus years. Pete Fancher, former Central Florida Chairman, is and always will be my good friend. He was always supportive of the Tampa Bay Classic for thirty plus years and always advised me in matters that served the competitor well and the best interest of Tampa Bay Classic with the NPC. Deke Warner, who is also my good friend, I had the privilege of judging as he climbed up the ladder of success in bodybuilding. His support of the Classic and my family will never be forgotten. Lastly and certainly not least is my dear friend Naz Agemy. For a great many years, Naz and his wife Patty have been key financial supporters and true advocates of the Tampa Bay Classic. I wish him, his entire family, and his devoted Discount Nutrition team the very best in health and success.
I wish all past Tampa Bay Classic competitors good luck in the future and as I told each and everyone at the competitors meeting before the show – “Today you are a Champion”!

Detailed Points:
I petitioned and asked through proper NPC guideline to be a National Qualifier. For 36 years of promoting the Tampa Bay Classic always giving the finest quality show and wanting to offer more for the competitor. We asked based on these reasons to be a National Qualifier status but was denied this request. So arguable you the competitor were denied this as well. The prestigious title of the Tampa Bay Classic over-all champion has been coveted for 36 years yet the powers to be in the Central District denied you the competitor and us the promoter this petition. We weren’t asking this for prestige, the Tampa Bay Classic title is prestigious enough, but for our champions to have the opportunity to be National Qualifier from the Tampa Bay Classic. This cost additional monies from the promoter for the sanction fee to be a National Qualifier be we and our champions deserve more. Per the NPC powers to be, every show is a National Qualifier except the Tampa Bay Classic and two others recently started shows compared to the Classic are not National Qualifiers and the thirty-six years old high-quality show is the third. Again, no respect for the great job and loyalty all these years of promoting the Tampa Bay Classic.
The NPC has taken control over the running/expediting of shows and mine is no exception. Not being able to produce, direct and run the Tampa Bay Classic leaves me to rely on other promoters/expediters of which I have no control and therefore no ability to guarantee the quality of a John Schleicher promoted Tampa Bay Classic. If I cannot control the quality and organizational flow of the show, then I no longer can answer for the production and results given. Having to pay for expediters will take away funds from my sponsors, which goes directly to having the best trophies and production showcase for my competitors.

As for athletes, we already have more competitors signed from the United States than the final amount at the December show’ boasts DeMilia. “Our goal is 100 athletes from the USA and we are well on our way to that number.” As for the theater and the hotel, estimates indicate that we will be looking at a sellout for the Ashe Auditorium as well as increasing our room block at the Hyatt Regency. “We feel confident of all of our forecasts regarding the theater and hotel” exclaims IFBBPA Executive AJ Bedway. “And after spending time with our Ashe Auditorium contact, Elizabeth Pardo, and our Hyatt Regency representative, Marysol Betancourt, working as a team with these two competent and knowledgeable executives will further insure an efficacious event!”

Congratulations Kim Gutierrez, representing Chile and Oddo's Angels for taking the Pro League Japan Pro Bikini title for 2019. Interestingly, this Pro League Japan Pro February 24, 2019 event had a bikini-clad seven member strong Team USA that could place no better than 6th place of the 17 competitors entered.
Placings included: 2nd- Beatriz Biscaia, Portugal 3rd- Nittaya Kongthun, Thailand 4th, Sung Uk Kim, South Korea 5th, Alessia Facchin, Italy 6th, Mansa Akbarimehr, USA 7th, Jessica Wilson, USA 8th, Breena Martinez, USA 9th, Michelle Brannan, UK 10th, Geri Berger, USA 11th, Haneul Seong, Korea 12th, Svetlana Elina, Russia 13th, Jewelyn Merrill, USA 14th, Na Thompson, USA 15th, Michelle Hurst, USA 16th, Jade McKee, Australia 16th, Katie Morris, Australia
No Japanese pros were entered in this event head judged by Sandy Williamson. Two Australians tied so-to-speak with 16th place as tradition is in this federation not to provide athletes that spend thousands of dollars prepping for the events the dignity of an actual distinct evaluation of placing once the placings drop to 16th even though some contest have more placing below that threshold than above. Yet, no one much complains for fear they will never place above 16th if they do.
No word on if bikini competitors must win three or four shows outright if not already Olympia qualified to make it to the National Inquirer, David Pecker event in Las Vegas in September.
Tamer Elguindy, contest promoter can be seen doing Cultural Appropriation with traditional Japanese attire while back in his home adopted state of California he would not dare.
On to the next show!

Interesting to see the new trend in allowing contest promoters in the Pro League to judge their own shows. Note Moe's signature on the New Zealand Pro scoresheets. Tamer for Muscle Contest International also comes to mind.
Congratulations to Abtin Shekarabi repping the Ayatollah of Iran for classic physique and Aaron Polites repping Australia in the 212 division. One Team USA member competed in the show Aaron Jeffery taking a fourth place out of nine in classic.

Jon Lindsay's expensive to attend MuscleContest California circuit run by the El Guidy Brazilian brothers lacked luster at their 2019 FitWorld event. They might have spun it as the finest physiques in the Pro League, but as Bob Cicherillo noted after the Arnold Classic, "PSA for all Pro's who placed at the Arnold Classic: Congratulations on your placing...BUT...youre NOT " 4th in the WORLD...6th in the WORLD, etc. You placed wherever you did AT THE ARNOLD. It aint the OLYMPIA."
Congratulations to Marvin Cornejo, El Paso, Texas for the victory over nine other pros.

Braun, Singerman Indictments

After the Department of Justice announced on March 13, 2019 the indictment of six individuals including PJ Braun and Aaron Singerman formerly of Blackstone Labs for spiking supplements with anabolic steroids and consumer fraud Braun the CEO of Blackstone fired back “The government intends to destroy the weight lifting industry by making it hard for lifters to use legal nutritional supplements.” Braun in a news release went on to state, “We intend to prevail” against the federal government in our righteous defense of the industry, The news release did not refute the presence of anabolic steroid spiking, but claimed their ingredients were akin to naturally occurring Picamilon while wrapping Blackstone's battle in the flag (or gym towel) as one that pits them as the defender of every one who lifts weights while the DOJ is set to prosecute based on controlled substance spiking of mislabeled products and fraud. No word as yet from Aaron Singerman, CEO of RedCon1. Meanwhile bodybuilding news websites including Muscular Development have deleted any postings by fans of the news on their industry forum as Singerman spreads lots of advertising dollars around to most all the NPC & Pro League media websites.

Six Individuals and Two Companies Charged in Illegal Dietary Supplement Scheme
Six people and two Florida corporations were charged in an indictment for their roles in a scheme to distribute illegal dietary supplements, the Department of Justice announced today.
Phillip Braun, 38, of Boca Raton, Florida, Aaron Singerman, 39, of Delray Beach, Florida, Robert DiMaggio, 49, of Henderson, Nevada, Anthony Ventrella, 41, of Boynton Beach, Florida, David Winsauer, 32, of Boca Raton, Florida, and James Boccuzzi, 34, of Parkland, Florida, were charged in a 14-count indictment that was returned by a federal grand jury in Miami, Florida on March 7, 2019, and was unsealed today. The indictment also charged Blackstone Labs and Ventech Labs, two Florida limited liability companies in Palm Beach County, Florida.
The indictment alleges that the defendants sold hundreds of thousands of illegal products, including anabolic steroids, nationwide and internationally, fraudulently representing that those products and pills were high-quality, legal dietary supplements. According to the indictment, the defendants created an illicit manufacturing company and routed sales of illegal products through trusted distributors, knowing that the products were unsafe or could not legally be sold to consumers.
“Fraud by supplement manufacturers and distributors is extremely dangerous for consumers, who rightly assume that a dietary supplement product sold in stores or online will not contain unapproved drugs,” said Assistant Attorney General Jody Hunt for the Department of Justice’s Civil Division. “These products are not safe and that is why we will continue to aggressively pursue and prosecute those who import, manufacture, and distribute dangerous and illegal ingredients for fraudulent purposes.”
“Consumers who use dietary supplements expect those products to be safe. When they contain drugs that are not FDA-approved, the health of the public is put at risk,” said Catherine A. Hermsen, Acting Director, FDA Office of Criminal Investigations. “We will continue to pursue and bring to justice those who place consumers’ health in jeopardy.”
All of the defendants were charged with one count of a conspiracy to defraud consumers and the Food and Drug Administration (FDA) by selling products labeled as dietary supplements that contained unapproved new drugs, illegal steroids, and other ingredients that were hazardous and prohibited by law. The indictment also charges Braun, an owner of Blackstone Labs, and Singerman, a former company owner, with two counts of introducing a product known as Super DMZ RX 2.0, an unapproved new drug, into interstate commerce. The maximum punishment for the conspiracy to defraud is five years in prison and a fine of $250,000 or twice the gross gain or loss from the offense. The maximum punishment for each of the two counts of introducing an unapproved new drug is three years in prison and a fine of $250,000 or twice the gross gain or loss from the offense.
The indictment further charges Braun, Singerman, and six other defendants with one count of a conspiracy to distribute anabolic steroids, which are Schedule III controlled substances under federal law and which may cause kidney failure, liver damage, and other permanent health problems when misused. The indictment alleges that one person suffered serious bodily injury from the use of one of the steroids involved in the conspiracy. The maximum punishment for the conspiracy to distribute controlled substances is 15 years’ imprisonment and a fine of $500,000 or twice the gross gain or loss from the offense.
The indictment additionally charges several defendants in three separate counts of distribution of anabolic steroids and charges Ventrella with one count of possession of an anabolic steroid with the intent to distribute. The maximum punishment for each count of distribution of a controlled substance and for the count of possession of a controlled substance with intent to distribute is 10 years in prison and a fine of $500,000. Finally, Braun and Singerman are each charged with three counts of money laundering. The maximum punishment for each money laundering charge is 10 years in prison and a fine of $250,000 or twice the amount of the property involved in the money laundering transaction.
“Illegal dietary supplements pose a public health risk,” stated U.S. Attorney Fajardo Orshan. “The U.S. Attorney’s Office for the Southern District of Florida and our partners at the Food and Drug Administration strive to ensure that consumers are fully apprised of the ingredients contained in the substances they are ingesting. Those who attempt to circumvent the law and create a public safety hazard will be held accountable.”
This case is being prosecuted by Trial Attorneys Alistair Reader and David Frank of the Department of Justice’s Consumer Protection Branch, with assistance from Daren Grove, Assistant United States Attorney for the Southern District of Florida. The case was investigated by FDA’s Office of Criminal Investigations with assistance from Sarah Hawkins of the Office of Chief Counsel. An indictment merely alleges that crimes have been committed. All defendants are presumed innocent until proven guilty beyond a reasonable doubt.
Additional information about the Consumer Protection Branch and its enforcement efforts may be found at www.justice.gov/civil/consumer-protection-branch. Blackstone Labs Responds to Governments Salacious Charges and Vows to Fight Back!
March 14, 2019 LINK TO SOURCE
BOCA RATON, FL., March 14, 2019 -- Blackstone Labs responds to the Government’s false and inaccurate charges against it and several Team Blackstone members by assuring all its worldwide customers it intends to vigorously defend the right of health conscious strength athletes, bodybuilders, and wellness professionals to access and use nutritional supplements that assist in muscle development and body tone. The indictment does not challenge any of Blackstone Labs' current product formulations. At all times, Blackstone has worked diligently to identify nutritional supplements that are wholesome, beneficial, and safe for the body, and it has promoted only products that fully comply with the law and prevailing practices. Blackstone Labs remains open for business.
It is Blackstone’s belief that the government is overreaching in this case because of its ongoing, wrong-headed attack on strength and bodybuilding athletes and the nutritional supplement industry. These false charges are no different from the allegations brought against the dietary ingredient Picamilon, a compound madefrom the naturally occurring dietary ingredients niacin and gamma-aminobutyric acid. Totally ignored by the Government in its assault on the supplement industry is the clear directive of the Food & Drug Act definition of a “dietary supplement” as a product (besides tobacco) that is “intended to supplement the diet” and that contains one or more of the following “dietary ingredients”: (A) a vitamin; (B) a mineral; (C) an herb or other botanical; (D) an amino acid; (E) a dietary substance for use by man to supplement the diet by increasing the total dietary intake; or (F) a concentrate, metabolite, constituent, extract, or combination of any ingredient described in clause (A), (B), (C), (D), or (E). Picamilon is clearly a dietary supplement and not illegal as it is a product combining a vitamin (niacin) and an amino acid (gamma-aminobutyric acid). Prominent health scientists have confirmed this fact.
Blackstone is fighting back for itself and all its loyal customers and all consumers. This is not our first battle against Government overreach. In October 2018, Blackstone’s lawyers sued the federal government for the return of the seizure of lawful dietary supplements from Blackstone’s warehouse, charging that prosecutors were abusing their power by attempting to force Blackstone to surrender its First Amendment right to distribute lawful dietary supplements.
Blackstone Labs, several of its key executives, including CEO PJ Braun, and former employees declared this week that they are prepared to battle the federal government over the sale and distribution of its dietary supplements. “The government intends to destroy the weight lifting industry by making it hard for lifters to use legal nutritional supplements,” said Blackstone. “That will not happen,” proclaimed Blackstone CEO PJ Braun. “We intend to prevail” against the federal government in our righteous defense of the industry,” according to Mr. Braun.
